مغامراتي مع قانون حق الحصول على المعلومات الأردني،،،

بعد ما اكتشفت انو في قانون اسمو " قانون حق الحصول على المعلومات " و اللي إلو طالع من سنة 2007، رحت على الموقع الالكتروني للتشريعات الأردنية و جبت نص القانون. و بديت أقرأ...

كلام جميل جدا، طلع في اشي اسمو مجلس المعلومات وهو المسؤول عن تطبيق القانون بس كيف بدي أطلب معلومات ،، لسى ما بعرف.. ما النا غير جوجل..كليك كليك فتشي يا تالا .. بحث عن " موقع مجلس المعلومات الاردني " .. لا شيء.. ما طلع إشي مفيد ، انتوا جربوا و قولولي شو بطلع معكم ( مع انو طلع في موقع إلهم بعدين... كمان شوي بتعرفوا كيف) ! شو نسوي ؟ صرت افتش عن مكونات المجلس، شو هوة مجلس المعلومات يعني؟ مين رئيس المجلس ؟ طلع وزير الثقافة . ومين وزير الثقافة؟ د. صبري ربيحات حسب موقع وزارة الثقافة، رحت بعتلوا بريد الكتروني قلتلو انا مواطنة اردنية اسمي تالا و مش عارفة كيف اطلب معلومات عن طريق قانون حق الحصول على المعلومات و شو هوة الإجراء المتبع للحصول على المعلومات... طبعا هادا الحكي صرلوا اسبوع و ما رد علي وهو أمر متوقع.. اللي بعدو على القائمة؟ مفوض المعلومات؟ مين حضرته، مدير عام المكتبة الوطنية .. و مين بكون؟ مأمون التلهوني ،، جوجل هيم،، بعدين.... يوريكا!! وصلت الى هذا المقال اللي عمره سنة و عنوانه يقول " لا شكوى من عدم الحصول على المعلومات!!!! " ..... طبعا ما رح يكون في شكوى إزى ما حدا عارف عن القانون و لاعارف كيف يستعمل النموذج و وين هو موجود أصلا!! بعدين عمره ما واحد قاس نجاحه بعدد الشكاوي اللي ما بتوصلو المفروض يقدم تقرير عن الطلبات اللي وصلت و مين الجهة اللي الناس بدها تعرف عنها و بركي كان في تكرار للطلبات، ليش يكون في إزدواجية في العمل.. لازم يكون في تسهيل و تسريع للإجراءات و مش تعقيدها! لأنو الاسلوب الحالي لا واضح و لا سهل و لا مزبوط !

بآخر المقال طلع في موقع الكتروني و رقم تليفون للشكاوي والملاحظات وهناك في نموذج لطلب المعلومات على الموقع

وعشان احكيلكم أديش النموذج تعيس و الإجراء أتعس ، إفتحوا هادا النموذج

1 . ولد بالصف السابع بعمل فورمات على مايكروسوفت اوفس احسن من هاد
2. لازم تكتب سبب طلب المعلومات و الخيارات هي إما للنشرأو للبحث والدراسة أو أخرى
3. لازم تقدم نسخة عن بطاقة الأحوال أو جواز السفر + الرقم الوطني و إزى كنت بتمثل جهة لازم تجيب تفويض و وين ساكن و شو بتشتغل!
4. لازم تروح تقدم النموذج شخصيا !!! وين ؟؟ مش على مجلس المعلومات! لازم تروح على الدائرة اللي بدك منها المعلومات عشان تاخد رقم ملف عشان تراجع فيه،،فهمنا ماشي! بس عند مين؟ كمان ما بعرف و مش واضح!! كإنو الدوائر الحكومية عبارة عن قردين وحارس.. مين بنسق بين مجلس المعلومات و كل الدوائر الحكومية و شو بعرف المجلس انو الدوائر بتبلغ عن الطلبات الواردة إلهم!
5. و بعد ما تروح و تسلم النموذج إزى عرفت وين تسلموه ممكن يوصل رد و ممكن ما يوصل والذي يعني طلبك تم رفضه خلال الشهر. اعتقد انه النموذج رح يضل شهر بالدائرة قبل ما يوصل للمسؤول اللي بقرر إزى بتستاهل تعرف أو لأ.
6. ازى كنت بدك تشتكي روح اشتكي لمفوض المعلومات !

طلبي و سؤالي بسيط : كيف ممكن تحولوا كل إجراءات عملية الطلب للمعلومات، التسجيل والتحويل للجهة المعنية والتنسيق والرد الى عملية إلكترونية مفتوحة للناس لتعرف و تشوف لأني حاليا حاسة حالي عايشة بالعصر الحجري

مادة1-
يسمى هذا القانون ( قانون ضمان حق الحصول على المعلومات لسنة 2007 ) ويعمل به من تاريخ نشره في الجريدة الرسمية

لمادة2-
يكون للكلمات والعبارات التالية حيثما وردت في هذا القانون المعاني المخصصة لها ادناه ما لم تدل القرينة على غير ذلك :-
المعلومات :أي بيانات شفوية او مكتوبة او سجلات او احصاءات او وثائق مكتوبة او مصورة او مسجلة او مخزنة الكترونيا او بأي طريقة وتقع تحت ادارة المسؤول او ولايته
الوثائق المصنفة :أي معلومات شفوية او وثائق مكتوبة او مطبوعة او مختزلة او مخزنة الكترونيا او بأي طريقة او
مطبوعة على ورق مشمع او ناسخ او اشرطة تسجيل او الصور الشمسية والافلام او المخططات او الرسوم او الخرائط او ما يشابهها والمصنفة على انها سرية او وثائق محمية وفق احكام التشريعات النافذة
الوثائق العادية :أي معلومات غير مصنفة تقع تحت ادارة المسؤول او ولايته
الدائرة :الوزارة او الدائرة او السلطة او الهيئة او أي مؤسسة عامة او مؤسسة رسمية عامة او الشركة التي تتولى ادارة مرفق عام
المسؤول :رئيس الوزراء او الوزير او الرئيس او المدير العام للدائرة
المجلس :مجلس المعلومات المؤلف بمقتضى احكام هذا القانون
الرئيس :رئيس المجلس / وزير الثقافة
مفوض المعلومات:مدير عام دائرة المكتبة الوطنية بالاضافة لوظيفته

المادة3-
أ- يؤلف بموجب هذا القانون مجلس يسمى ( مجلس المعلومات ) ويشكل على النحو التالي :-
1- وزير الثقافة رئيسا
2- مفوض المعلومات نائباً للرئيس
3- امين عام وزارة العدل عضوا
4- امين عام وزارة الداخلية عضوا
5- امين عام المجلس الاعلى للاعلام عضوا
6- مدير عام دائرة الاحصاءات العامة عضوا
7- مدير عام مركز تكنولوجيا المعلومات الوطني عضوا
8- مدير التوجيه المعنوي في القوات المسلحة عضوا
9- المفوض العام لحقوق الانسان عضوا
ب- لا يتقاضى رئيس واعضاء المجلس أي مكافآت من خزينة الدولة

المادة4-
يتولى المجلس المهام والصلاحيات التالية :-
أ-ضمـان تزويد المعلومات الى طالبيها في حدود هذا القانون
ب-النظر في الشكاوى المقدمة من طالبي الحصول على المعلومات والعمل على تسوية هذه الشكاوى وفقا لتعليمات يصدرها لهذه الغاية
ج-اعتماد نماذج طلب المعلومات
د- اصدار النشرات والقيام بالانشطة المناسبة لشرح وتعزيز ثقافة الحق في المعرفة وفي الحصول على المعلومات
هـ- اقرار التقرير السنوي حول إعمال حق الحصول على المعلومات المقدم من مفوض المعلومات ورفعه الى رئيس الوزراء

لمادة5-
أ- يجتمع المجلس مرة واحدة على الاقل في الشهر او كلما دعت الحاجة الى ذلك بدعوة من الرئيس او نائبه عند غيابه او بناء على طلب مقدم من اربعة من اعضاء المجلس على الاقل لبحث الامور المحددة في هذا الطلب
ب-يكون الاجتماع قانونياً بحضور ما لا يقل عن خمسة اعضاء على ان يكون من بينهم الرئيس او نائبه ، وتتخذ القرارات بالاجماع او أكثرية اصوات اعضاء المجلس
ج-للمجلس دعوة أي شخص من ذوي الاختصاص والخبرة لحضور اجتماعاته دون ان يكون له حق التصويت عند اتخاذ قراراته

المادة6-
أ- يتولى مفوض المعلومات المهام والصلاحيات التالية :-
1- اعــداد نماذج طلب المعلومات بالتعــاون مع الدائرة وتقديمها الى المجلس
2-اعداد التعليمات المتعلقة بقبول الشكاوى واجراءات تسويتها وتقديمها الى المجلس لاصدارها
3-تلقي الشكاوى من مقدمي طلبات الحصول على المعلومات وتقديمها الى المجلس لتسويتها
4-القيام بالاجراءات الادارية والمهنية اللازمة لتنفيذ المهام والصلاحيات المنوطة به
ب- تقوم دائرة المكتبة الوطنية بتوفير الخدمات الادارية والمهنية اللازمة لتأدية المهام والمسؤوليات المنوطة بالمجلس ومفوض المعلومات بموجب احكام هذا القانون

المادة7-
مع مراعاة احكام التشريعات النافذة ، لكل اردني الحق في الحصول على المعلومات التي يطلبها وفقا لاحكام هذا
القانون

لمادة8-
على المسؤول تسهيل الحصول على المعلومات ، وضمان كشفها دون ابطاء وبالكيفية المنصوص عليها في هذا القانون

لمادة9-
أ- يقدم طلب الحصول على المعلومات وفق الانموذج المعتمد لهذه الغاية متضمنا اسم مقـــدم الطلب ومكان اقامته وعمله واي بيانات اخرى يقررها المجلس
ب-يحدد مقدم الطلب موضوع المعلومات التي يرغب في الحصول عليها بدقة ووضوح
ج-على المسؤول اجابة الطلب او رفضه خلال ثلاثين يوما من اليوم التالي لتاريخ تقديمه
د- يشترط في حال رفض الطلب ان يكون القرار معللا ومسببا ، ويعتبر الامتناع عن الرد ضمن المدة المحددة قرارا بالرفض

المادة10-
لا يجوز طلب المعلومات التي تحمل طابع التمييز الديني او العنصري او العرقي او التمييز بسبب الجنس او اللون

لمادة11-
أ- يتحمل مقدم الطلب الكلفة المترتبة على تصوير المعلومات المطلوبة بالوسائل التقنية او نسخها ويجري اطلاع مقدم الطلب على المعلومات اذا كانت محفوظة بصورة يتعذر معها نسخها او تصويرها
ب-اذا كان جزء من المعلومات المطلوبة مصنفا ، والجزء الاخر غير مصنف فتتم اجابة الطلب بحدود المسموح به وفقا لاحكام هذا القانون
ج-اذا كانت المعلومات مصنفة ، فيجب ان يكون تصنيفها سابقا على تاريخ طلب الحصول عليها

المادة12-
اذا كانت المعلومات المطلوبة غير متوفرة او تم اتلافها لمرور الزمن فيتعين على المسؤول بيان ذلك لمقدم الطلب

لمادة13-
مع مراعاة احكام التشريعات النافذة ، على المسؤول ان يمتنع عن الكشف عن المعلومات المتعلقة بما يلي :-
أ-الاسرار والوثائق المحمية بموجب أي تشريع اخر
ب-الوثائق المصنفة على انها سرية ومحمية والتي يتم الحصول عليها باتفاق مع دولة اخرى
ج-الاسرار الخاصة بالدفاع الوطني او امن الدولة ، او سياستها الخارجية
د-المعلومات التي تتضمن تحليلات او توصيات او اقتراحات او استشارات تقدم للمسؤول قبل ان يتم اتخاذ قرار بشأنها ، ويشمل ذلك المراسلات والمعلومات المتبادلة بين الادارات الحكومية المختلفة حولها
هـ- المعلومات والملفات الشخصية المتعلقة بسجلات الاشخاص التعليمية او الطبية او السجلات الوظيفية او الحسابات او التحويلات المصرفية او الاسرار المهنية
و-المراسلات ذات الطبيعة الشخصية والسرية سواء كانت بريدية او برقية او هاتفية او عبر اي وسيلة تقنية اخرى مع الدوائر الحكومية والاجابات عليها
ز-المعلومات التي يؤدي الكشف عنها الى التأثير في المفاوضات بين المملكة واي دولة او جهة اخرى
ح-التحقيقات التي تجريها النيابة العامة او الضابطة العدلية او الاجهزة الامنية بشأن اي جريمة او قضية ضمن اختصاصها وكذلك التحقيقات التي تقوم بها السلطات المختصة للكشف عن المخالفات المالية او الجمركية او البنكية ما لم تأذن الجهة المختصة بالكشف عنها
ط-المعلومات ذات الطبيعة التجارية او الصناعية او المالية او الاقتصادية والمعلومات ، عن العطاءات او البحوث العلمية او التقنية التي يؤدي الكشف عنها الى الاخلال بحق المؤلف والملكية الفكرية او بالمنافسة العادلة والمشروعة او التي تؤدي الى ربح او خسارة غير مشروعين لاي شخص

المادة14-
أ- على كل دائرة ان تقوم بفهرسة وتنظيم المعلومات والوثائق التي تتوافر لديها حسب الاصول المهنية والفنية
المرعية وتصنيف ما يتوجب اعتباره منها سرياً ومحمياً حسب التشريعات النافذة خلال مدة لا تتجاوز ثلاثة اشهر من تاريخ
نشر هذا القانون في الجريدة الرسمية
ب- في حال عدم استكمال تنفيذ احكام الفقرة (أ) من هذه المادة خلال المدة الواردة فيها ، يتعين على المسؤول الحصول على
موافقة رئيس الوزراء لتمديدها لمدة لا تتجاوز ثلاثة اشهر اخرى

المادة15-
عند تولي مدير عام دائرة المكتبة الوطنية مهام مفوض المعلومات بالاضافة لوظيفته تنحصر مسؤوليته القانونية
فيما يتعلق بالمعلومات المحفوظة في دائرته

لمادة16-
للمسؤول ان يفوض أيا من صلاحياته المنصوص عليها في هذا القانون لاي من كبار موظفي الدائرة على ان
يكون التفويض خطياً ومحدداً

المادة17-
أ- تختص محكمة العدل العليا بالنظر في قرار رفض طلب الحصول على المعلومات على ان تقدم الدعوى من مقدم الطلب ضد المســؤول خــلال (30) يوماً من اليوم التالي لتاريخ انتهاء المدة الممنوحة بموجب هذا القانون لاجابة الطلب او رفضه او الامتناع عن الرد عليه
ب-يجوز لمقدم الطلب تقديم شكوى ضد المسؤول الى المجلس بواسطة مفوض المعلومات في حال رفض طلبه او امتناع المسؤول عن اعطاء المعلومات المطلوبة خلال المدة المقررة قانوناً
ج-على المجلس ان يصدر قراره في الشكوى خلال ثلاثين يوماً من تاريخ ورودها والا اعتبرت الشكوى مرفوضة وتقطع الشكوى ميعاد الطعن الموجه ضد المسؤول المنصوص عليه في الفقرة (أ) من هذه المادة ويبدأ سريان مدة الطعن من تاريخ تبليغ مقدم الشكوى رفض شكواه الصريح او من تاريخ انقضاء المدة لاصدار قرار المجلس في الشكوى

المادة18-
يحدد مقدار أي بدل تستوفيه الدائرة مقابل تصوير المعلومات المطلوبة او نسخها بقرار من مجلس الوزراء بناء على تنسيب المجلس

المادة19-
يصدر مجلس الوزراء الانظمة اللازمة لتنفيذ احكام هذا القانون بما في ذلك نظام تحدد فيه الوثائق المحمية التي يجوز الكشف عنها والتي مضى على حفظها مدة لا تقل عن ثلاثين سنة

لمادة20-
رئيس الوزراء والوزراء مكلفون بتنفيذ احكام هذا القانون

Freedom of Information

I was searching online for some information about British Gas after reading THIS

I stumbled on this website which lead me to something called the freedom of information Act (FOIA) implemented in UK which is something I wish if it could be implemented in Jordan since we badly need it, we need transperancy, we need to inform the public about how the government is operating,and the bases on which people in charge are making decisions. its our right to know.

the FOIA goes like this:

Any person can make a request under the Act - there are no restrictions on your age, nationality, or where you live.

All you have to do is write to (or email) the public authority that you think holds the information you want. You should make sure that you include:

• your name
• an address where you can be contacted
• a description of the information that you want

You don't have to mention the Freedom of Information Act, but there is no reason not to if you want to.

You should try to describe the information you want in as much detail as possible - for example "minutes of the meeting where the decision to do X was made", rather than "everything you have about X". This will help the public authority find the information you need.

Public authorities must comply with your request promptly, and should provide the information to you within 20 working days (around a month). If they need more time, they must write to you and tell you when they will be able to answer your request, and why they need more time


I think Freedom of Information is a prerequisite to Freedom of Speech for we, need the power to request information first. there are many things I wanna see , PLEAAASE

WHY ?

You pay taxes, and then government does things with the money. All sorts of things that affect your life, from healthcare through to national defence. Some it does badly, some it does well. The more we find out about how government works, the better able we are to make suggestions to improve the things that are done badly, and to celebrate the things that are done well.

I think its perfectly doable.

We live in a society were women willingly submit to men, we obey, we allow the father figure to manage our lives for security & stability, we developed a need for protection by the male from the male, the workforce is male dominant, those who set up the rules are males, women keep silent out of respect and because of the precedence of the family unit in our priorities, but it turns to ownership that extends to how we should live and how to mold our lives to fit into our roles.

You know how I picture women in our society; we are like butterflies in a glass enclosure where we have limited fields to venture in, and are brought to think that this garden we have is paradise, thats why we are always thankful that we have a system to rely on regardless of how much it eats from our individuality. Thats why women obsess with things like " virginity being a family concern, marriage race, what if he divorced me, what if he married a second one, turn a blind eye to him cheating, quit the job to bring up kids, he yells at me, he started beating me.." you know the rest of the record.

you always need to satisfy the society & the "him" in the equation because you depend on him. you are never ever independent or learned to stand alone. If its not him, then its the family, you never own your space, something for yourself , when have you really thought of yourself alone, you know you can't ignore how much your family and society play a role in most if not all the decisions you make. you are either a sister, a daughter, a girlfriend, a wife, a mother "first". you were never "you" first before being any of those roles and think of about all your behaviors and how it serves these roles. where is you?

so you ask me what do you want? I tell you, I want legal safety, justice, more freedom, better education and civil rights for my gender.

Today, I wont talk about the cases where murdered women were proven innocent, this is an evident proof of a failure of the juridical system. when a woman whether guilty or not regardless of what guilty means, is killed and the killer gets away, this means I mean nothing to the system that I subscribe to and yeah I am less than a man in this case.

in Christianity it is written: " Do Not Kill " & in Islam you are not to kill a woman who commits adultery, not you, not by yourself without witnesses & this is exactly why there are courts. The raging reaction and the momentary insanity is bullshit & saying its a tradition is even more bullshit.

Gray water is an affordable home scale solution

Every Wednesday in Amman, the water line gets connected to our neighborhood so early morning, dad irrigates the trees around the house, we do the laundry in the afternoons, clean the backyard and our neighbors would wash the stairs and do the windows, most people do the same the stuff on that day.

I was thinking to myself after I read this piece of news, and this news quoting;

AMMAN, Jan 21 (KUNA) -- Jordanian authorities on Wednesday warned of the decrease of the per capita water share to 104 square metres by 2025, in comparison to 145 square metres at the time being, due to the current rise in the population of 2.2 percent. The continued rise of 3.6 percent in the overall birth rate according to a study conducted by the Higher Population Council in cooperation with the Jordanian Ministry of Water, will lessen the per capita share of water by 48 percent, said the council's Secretary General Raeda Al-Qutob.

All our home use water is done with fresh water!! imagine, if we were able to store the water we use while showering and doing the laundry and using this Gray water for stuff that doesn't require fresh water, lets water our home gardens with gray water & utilize space to grow home vegetables.

This way we save money because we use less water from the Water Authority, we would be doing Jordan a favor by lessening our consumption, we re-use the water and we get fruits and vegetables from our home.


people! just consider this information: you flush your toilet with fresh water.

for Gray water systems to be applicable in Jordan there are 3 things:

1- necessary regulations for gray water through the water authority to set the guidelines.
2- awareness campaign on what Gray water is!
3- having suppliers for these kinds of systems

many many many technologies are available.

Starting Tomorrow Sunday, January 11th, you can lend a hand at the Aramex warehouse where a great deal of donations need to be sorted and packaged. The warehouse, located in Al-Qastal (see map) will be open to volunteers between 4pm and 9pm every single day until the job is done.

the faster the job gets done, the quicker the trucks move, the faster it reaches to people in need. money doesn't immediately get the aid there, please help if you could manage to reach the warehouse.

at the end of each day, this little contribution is as big as the world and makes all the difference and your action will awaken a numb, will heal a wound, and will write a future..

There is a 48-hr campaign that will start Tomorrow to collect Blankets, Canned Food, and Clothes for Gaza. It is organized by Action Committee and 7iber . I don't have further details yet.

The people at 7iber and the Action Committee are organizing an emergency clothes and food drive for the people in Gaza.

It’ll be a 48-hour campaign starting tomorrow morning, with the goods being delivered to Gaza by coming weekend.

This is all going to be driven through the virtual community, with contributions of Jordanian bloggers and their readers, as well as Facebook, emails and just about anyone connected online. It’s the fastest way to spread the word in a short period of time.

on Greater Amman Municipality Website : Neighborhood Parks and Community Facilities

I have been thinking about this for a while now, and I wanted to introduce this idea;

Neighborhood Parks and Community Facilities are two different terms
what do we mean by those and why do we need them?

A Neighborhood Park is an open facility for community that would be in the range of 1- 2 dunums (2000 square meters/ .2 Hectares) dedicated and set for neighborhoods that have high population densities and administered by the Municipality.

A Neighborhood Park is a simple open space and I need to stress on this integral idea, it doesn't have to be big or full of " 7ajar ", also, its not fragments of a street, its a one whole area dedicated for people who can't afford the space, established in a way to be near the areas they live in so they won't need to commute, hence called neighborhood park.

now in one Dunum land area in a neighborhood, what can you put on this land when it comes to design?

Any of those;

1- sand area with playground equipment on a "level" land for [ 3-6 ] years old children
2- picnic tables and benches under a fixed tent for sun protection
3- Basketball Court
4- Soccer Court
5- multipurpose field
5- Signs
5- Jog and exercise course
6- Green space, you can put ornamental trees, grass with efficient irrigation system, plant certain types of trees; we don't have problems with soil or weather in Jordan, but think green, no need for 7ajar.
7- swings ( when was the last time you adults were on a swing?)
8- parking

if Greater Amman Municipality is thinking of pavements inside the parks, this is a personal request, pleaase don't use what you used in Rainbow street, there is something called " concrete interlock pavements " which is awesome, flat, solid, pretty and easy to clean and maintain, you can walk and run in the park, I wish I can see parks where the width is enough to take four people standing side by side. as simple as this, wide flat and green.

Now lets think of where should these Parks be at, since they are not big in size, this is what needs to be done:

1- check out the neighborhoods in Amman, concentrate on east Amman first before beautifying west Amman

I was looking up online, I got to this map and it divides Amman into 27 areas and these areas respectively into neighborhoods. ( click on each area to see the neighborhoods)

after mapping the neighborhoods, determine the most dense, the poorest and

2 - suggest several small pieces of Land that belong to the government and are not developed and are close to highly populated areas

3- within the radius of 500 m surrounding each suggested land mark out the points where there are :

A- Schools
B - Mosques / Churches
C- Community Facilities
D- Libraries
E- Clubs

and then develop an understanding for the area needs and make a design for what you can put on the land for the youth and families of this area, hence the requirements while keeping in mind safety measures and standards and lets learn from Rainbow Street Example

4- since we have the land, the area, the requirements, hence we have an initial idea of what we want to do on this plot.

another fantastic tool is wikimapia for Amman, you will find hilarious information there. but on the other hand you can add information about areas that needs help as well, you can use it to map the less fortunate areas. Amman is big and there are places I personally never been to. so people lets widen the scope and think collectively and prioritize development to infrastructure so poor people can contribute and this comes through providing support to their day to day micro-communities experience.

so, whats the difference between a neighborhood park and a community facility?

its basically the area and the purpose.

community facilities are measured in hectars, ya3ni 5 dunum w tloo3, Hussein Gardens are considered community facility, and when it comes to the purpose of these facilities, its either; family gathering areas for picnics and BBQ, athele specific areas for workout with various kinds of courts, bcycle rentals, running track, children play area, space for Landscape displays; like fountains and ponds, public theatres, cultural display.

a decent example for a communit facility is Al-Safa Park - Dubai / Community Facility

as for Greater Amman Municipality Website , I was looking for the districts and then I went to Abdali Disrtict/public parks to look up public parks and I had to wonder how come they consider " sahat Paris " a public park? its a roundabout with cars arount it right?

Poverty on papers and Jordan

There are many ways to measure poverty, there is whats called Measure I and Measure II ; Measure I examins how inequality and vulnerability can be used to measure poverty. Measuring Poverty II talks about two common indices used to measure poverty, UN Human Development Index (HDI) and the Human Poverty Index (HPI)

The HDI for Jordan is 0.773, which gives the country a rank of 86^th out of 177 countries for 2005 data reported in 2007/2008 report.

Countries on the same level of HDI as Jordan can have very different levels of income. Of the components of the HDI, only income and gross enrolment are somewhat responsive to short term policy changes. For that reason, it is important to examine changes in the human development index over time. but I don't know about now, like so much happened on the political and economic realm since 2005 in Jordan.

The HDI measures the average progress of a country in human development. The Human Poverty Index for developing countries (HPI-1), focuses on the proportion of people below a threshold level in the same dimensions of human development as the human development index - living a long and healthy life, having access to education, and a decent standard of living. By looking beyond income deprivation, the HPI-1 represents a multi-dimensional alternative to the $1 a day poverty measure.

The HPI-1 value of 6.9 for Jordan, ranks 11^th among 108 developing countries for which the index has been calculated.

The HPI-1 measures severe deprivation in health by the proportion of people who are not expected to survive age 40. Education is measured by the adult illiteracy rate. And a decent standard of living is measured by the unweighted average of people without access to an improved water source and the proportion of children under age 5 who are underweight for their age. still I don't think this measure is practical enough, its a great indicator but it doesn't advice anything about improving measures, because its responsive to policies but doesn't tell how to fix it. rankings are ok, but there is a lot of room for improvements especially in camps and rural cities. and the truth is, we didnt see the data past 2007, so reality now is different.

Poverty : Broad Strokes

while preparing to write about Poverty, I discovered that I didn't know how to answer basic questions relating to it and that its a complex issue hiding behind a word, its not a simple problem to say the least, and while surfing the web for an understanding to poverty relating to where we are, I came with this structure with simplified answers to follow:

how to define poverty?
Who is considered poor?
How to statistically measure poverty?
where are the poor in Jordan? how about the rest of the world?
What needs to be done?
can we translate that to action?

see people, what I was looking for is: if I want to develop a content that can be given to others that says " this content will help fight poverty " what would it be?? I don't see quite well, I don't have answers but this is what I hope we would get to all together, lets think, many heads are definitely better than one

who is responsible for poverty — government, society or the individual?

How to measure poverty? Who are The poor?

one way is to use income as the single criterion for judging who is poor.

should the family of a hardworking full-time employee earning the minimum wage be blamed for poverty because the minimum no longer lifts the worker's income above the poverty level? should we look into neighborhoods?

Speaking of Investments in Jordan

I was just watching the news on Dubai TV and they were talking about the current international financial crisis and how there is a lack of worldwide liquidity and then they brought a report on His Majesty King Abdallah addressing Jordan House of Parliament about our financial policies and banking sector and how to battle inflation, I wish if only people understand how important is what he said.. people don't understand where we are heading to and how long will it take to reflect on people. I wish I can show you old pictures of Dubai and how it looks now, it was about fishermen and desert.. nothing more! nothing... Dubai will run out of oil soon.. why do you think there is plan "B" ??

Tomorrow is the opening of cityscape Dubai ; is the largest business-to-business real estate investment and development event in the world, under Jordan there will be 2k, Abdali investment and Development PSC, Amlak Newspaper, Aqaba Development Corporation, and Mawared International, its very interesting to see how big the transactions are going to be considering the current global financial state,, it is expected to have lots of russian investors, and there is the notion of holding on to cash now or to use it wisely.

All we can do now is bring in investors, and meanwhile conserve our resources, fix our laws, increase people's awareness about their practices and work hard in our instituations to serve the citizens with what we got, facilitate their lives the best we can, constantly developing ourselves for better performance. better performance should be a national duty in all public sectors. cut costs cut costs cut costs ... and be more efficient...

we don't set goals that are visible to our citizens, like all what i saw in abadali project is that it stole a neighborhood, and it increased the land prices, there is too much planning needed, Jordan is very promising but it needs the people to get engaged about what will Jordan be like in 2025!!

التعديلات الحرفية في قانون الاحوال الشخصية الاردني المؤقت

المادة1-
يسمى هذا القانون ( قانون معدل لقانون الاحوال الشخصية لسنة 2001 ) ويقرأ مع القانون رقم (61) لسنة 1976 المشار اليه فيما يلي بالقانون الاصلي وما طرأ عليه من تعديل قانونا واحدا ويعمل به من تاريخ نشره في الجريدة الرسمية.

المادة (1)
يسمى هذا القانون ( قانون الاحوال الشخصية لسنة 1976 ) ويعمل به من تاريخ نشره في الجريدة الرسمية.

المادة2-
يلغى نص المادة (5) من القانون الاصلي ويستعاض عنه بالنص التالي:-
المادة5-
ــــــــــــــــــــ
يشترط في اهلية الزواج ان يكون الخاطب والمخطوبة عاقلين وان يكون كل منهما قد اتم الثامنة عشرة سنة شمسية الا انه يجوز للقاضي ان يأذن بزواج من لم يتم منهما هذا السن اذا كان قد اكمل الخامسة عشرة من عمره وكان في مثل هذا الزواج مصلحة تحدد اسسها بمقتضى تعليمات يصدرها قاضي القضاة لهذه الغاية.

لمادة (5)
يشترط في اهلية الزواج ان يكون الخاطب والمخطوبة عاقلين وان يتم الخاطب السنة السادسة عشرة وان تتم المخطوبة الخامسة عشرة من العمر.

المادة3-
يعدل القانون الاصلي باضافة المادة (6) مكرر اليها بالنص التالي:-

أ- يتوجب على القاضي قبل اجراء عقد الزواج المكرر التحقق مما يلي:-
1- قدرة الزوج المالية على المهر والنفقة.
2- اخبار الزوجة الثانية بان الزوج متزوج باخرى.
ب- على المحكمة اعلام الزوجة الاولى بعقد الزواج المكرر بعد اجراء عقد الزواج.

المادة (6)
أ- للقاضي عند الطلب حق تزويج البكر التى اتمت الخامسة عشرة من عمرها من الكفوء في حال عضل الولي غير الاب او الجد من الاولياء بلا سبب مشروع.
ب-اما اذا كان عضلها من قبل الاب او الجد فلا ينظر في طلبها الا اذا كانت اتمت ثمانية عشر عاما وكان العضل بلا سبب مشروع.

لمادة4-
تعدل المادة (63) من القانون الاصلي باضافة عبارة ( على ان يوثق ذلك رسميا امام القاضي ) بعد عبارة ( كاملي اهلية التصرف ) الواردة فيها.

المادة (63)
للزوج الزيادة في المهر بعد العقد وللمرأة الحط منه اذا كان كاملي اهلية التصرف ويلحق ذلك بأصل العقد اذا قبل به الطرف الآخر في مجلس الزيادة او الحط منه.

المادة5-
يلغى نص المادة (68) من القانون الاصلي ويستعاض عنه بالنص التالي:-
المادة68-
ـــــــــــــــــــــ
تستحق الزوجة التي تعمل خارج البيت نفقة بشرطين:-
أ- ان يكون العمل مشروعا.
ب- موافقة الزوج على العمل صراحة او دلالة ، ولا يجوز له الرجوع عن موافقته الا لسبب مشروع ودون ان يلحق بها ضررا.

المادة (68)
لا نفقة للزوجة التى تعمل خارج البيت بدون موافقة الزوج

المادة6-
تعدل المادة (126) من القانون الاصلي باعتبار ما ورد فيها فقرة (أ) واضافة الفقرتين (ب) و (ج) التاليتين اليها:-
ب- للزوجة قبل الدخول او الخلوة ان تطلب الى القاضي التفريق بينها وبين زوجها اذا استعدت لاعادة ما استلمته من مهرها وما تكلف به الزوج من نفقات الزواج وللزوج الخيار بين اخذها عينا او نقدا ، واذا امتنع الزوج عن تطليقها يحكم القاضي بفسخ العقد بعد ضمان اعادة المهر والنفقات.
ج- للزوجين بعد الدخول او الخلوة ان يتراضيا فيما بينهما على الخلع فان لم يتراضيا عليه واقامت الزوجة دعواها بطلب الخلع مبينة باقرار صريح منها انها تبغض الحياة مع زوجها وانه لا سبيل لاستمرار الحياة الزوجية بينهما وتخشى ان لا تقيم حدود الله بسبب هذا البغض وافتدت نفسها بالتنازل عن جميع حقوقها الزوجية وخالعت زوجها وردت عليه الصداق الذي استلمته منه حاولت المحكمة الصلح بين الزوجين فان لم تستطع ارسلت حكمين لموالاة مساعي الصلح بينهما خلال مدة لا تتجاوز ثلاثين يوما فان لم يتم الصلح حكمت المحكمة بتطليقها عليه بائنا.

المادة (126)
اذا ثبت قبل الدخول عجز الزوج باقراره او بالبينة عن دفع المهر لمعجل كله او بعضه فللزوجة ان تطلب من القاضي فسخ الزواج القاضي يمهله شهرا فاذا لم يدفع المهر بعد ذلك يفسخ النكاح ينهما ، اما اذا كان الزوج غائبا ولم يعلم له محل اقامة و لا مال له يمكن تحصيل المهر منه فانه يفسخ بدون امهال.

المادة7-
يلغى نص المادة (134) من القانون الاصلي ويستعاض عنه بالنص التالي:-
المادة134-

اذا طلق الزوج زوجته تعسفا كأن طلقها لغير سبب معقول وطلبت من القاضي التعويض حكم لها على مطلقها بتعويض لا يقل عن
نفقة سنة ولا يزيد على نفقة ثلاث سنوات ويراعى في فرضها حال الزوج عسرا ويسرا ويدفع جملة اذا كان الزوج موسرا واقساطا
اذا كان معسرا ، ولا يؤثر ذلك على حقوقها الزوجية الاخرى.

المادة (134)
اذا طلق الزوج زوجته تعسفا كأن طلقها لغير سبب معقول وطلبت من القاضي التعويض حكم لها على مطلقها بالتعويض الذي يراه
مناسباً بشرط ان لا يتجاوز مقدار نفقتها عن سنة ويدفع هذا التعويض جملة او قسطاً حسب مقتضى الحال ويراعى في ذلك
حالة الزوج يسرا وعسرا و لا يؤثر ذلك على باقي الحقوق الزوجية الاخرى للمطلقة بما فيها نفقة العدة.

المادة8-
يلغى نص المادة (163) من القانون الاصلي ويستعاض عنه بالنص التالي:-
المادة163-
ــــــــــــــــــــــــ
أ- يتساوى حق الام وحق الولي في مشاهدة الصغير عندما يكون في يد غيره ممن له حق حضانته.
ب- عند الاختلاف في مشاهدة الصغير تحدد رؤيته للام والولي مرة كل اسبوع وللاجداد لأم والجدات مرة في الشهر ولباقي
من لهم حق الحضانة مرة في السنة.
ج- للقاضي تحديد زمان المشاهدة ومكانها حسب مصلحة الصغير اذا لم يتفق الطرفان على ذلك.

المادة (163)
يتساوى حق الام وحق الاب او الجد لاب في رؤية الصغير عندما يكون في يد غيره ممن له حق حضانته.

هل تشجع قانون الاحوال الشخصية المؤقت

هناك مشروع قائم حاليا يهدف الى دفع البرلمان الاردني على الموافقة على اقرارقانون الاحوال الشخصية المؤقت ل 2001 فيما يخص الزواج و المرأة

ويركز المشروع على إقرار ستة بنود، وهي ضرورة الإبقاء على تعديل رفع سن الزواج للذكر والأنثى إلى ثماني عشرة سنة، والإبقاء على مبدأ حق المرأة في الخلع القضائي، وتأكيد أهمية رفع مقدار التعويض عن الطلاق التعسفي إلى ثلاث سنوات كحد أعلى.

والتعديل الخاص بالزواج المكرر، إذ أوجب القانون المعدل على القاضي، وقبل إجراء عقد الزواج المكرر، التحقق من قدرة الزوج المالية على المهر والنفقة، كما أوجب على القاضي إخبار الزوجة الثانية بأن الزوج متزوج بأخرى، وكذلك أوجب على المحكمة وفق التعديل الجديد إعلام الزوجة الأولى بعقد الزواج المكرر بعد إجراء عقد الزواج.

ويطالب بإقرار المادة المتعلقة بنفقة الزوجة العاملة، إذ أصبحت الزوجة، وحسب القانون المعدل (المؤقت)، تستحق النفقة إذا كانت تعمل عملا مشروعا وإذا وافق الزوج على العمل صراحة أو دلالة، ولا يجوز له الرجوع عن موافقته إلا لسبب مشروع ودون أن يلحق بها ضرراً.

وجاء التعديل لمنع استغلال الزوجة من قبل الزوج، ورضوخها لمزاجيته، ولحماية الزوجة من إضرار الزوج بها والتضييق عليها.

وبخصوص حق المشاهدة فيطالب التحالف بإقرار المادة كما نص عليها القانون المؤقت على النحو التالي: يتساوى حق الأم وحق الولي في مشاهدة الصغير عندما يكون في يد غيره ممن له حق حضانته، وأعطى القانون المؤقت الحق للقاضي- عوضا عن مأمور الإجراء - في تحديد زمان المشاهدة ومكانها حسب مصلحة الصغير إذا لم يتفق الطرفان على ذلك.

وجاء هذا التعديل للمحافظة على صلة الطفل بأمه وأهله، وللإبقاء على المودة والمحبة والترابط، وللابتعاد بالصغير عن أجواء الخلافات والمشاكل.

التعديل عالق في المجاس و حسب المقال

ويرى القاضي الشرعي الدكتور واصف البكري أنه من الأفضل أن يتم التصدي للموضوع من قبل أصحاب الاختصاص في الشريعة، على أنه لا ينبغي بحسبه أن يترك الباب مفتوحا للاجتهاد لمن لا تنطبق عليهم شروط الاجتهاد الشرعي.

وطالب بعرض قانون الأحوال الشخصية المؤقت على مجلس الإفتاء حتى توضح بنوده من أهل الاختصاص.

ولفت القاضي البكري وهو من الأشخاص الذين شاركوا في وضع تعديلات القانون، أن بعض نواب المجلس الماضي رفضوا القانون لاعتقادهم أنه جاء بإملاءات، موضحا أنه لو تم التصدي للأمر من قبل أهل الاختصاص لكان الوضع اختلف. (مصدر)

In university requirement classes like General Safety Principles, Ecology, and other courses where a class has at least 150+ students from different faculties, teachers use big old projectors and transparency paper slides of the actual book pages or exact passages, -yup they still use those, fine if you wanna use it for a graph but text, I don't think so- the teacher goes over the content in a one man show, reading off , alone! there is no use of attending these classes, the exam is a multiple choice that you know you would pass if you read the book, a total waste of energy and most of these classes are too boring, a bigger class requires a variety of methods to keep students focused, believe me I tried to stay focused on what he is saying in military science, in horticulture, but I couldn't. I lose the lecturer at least twice during the class and I am quite a good listener, the Arabic 101 , 102 books and instructors are terrible. Check the books for yourself. we don't take "أدب عربي و تعبير فكري عربي" we take " بصم عربي و كيفية النفاق بالعربي "

In other classes towards the humanitarian faculties some Drs do some underlining in the class while reading to students, students attend these classes because attendance is mandatory and most of the time you have to stick to the seat number, the only question a student would ask is " is this chapter included in the exam? "

Speaking of questions, shouldn't a class provoke questions? 80% of the classes rarely raise questions from students, most of the time, Drs don't like to be interrupted and some of those Drs give you an impression that you are stupid to ask such a question or " inta mish mtabbe3 3ashan heik ma fhimet aw shiklak mish fa6er ". bil 3arabi bisharshe7u bi karamtak il ard iza 7akait mish fahem.. few and really really few Drs welcome a student saying I didn't understand what you just said in class.

We didn't learn the philosophy of science, we didn't dedicate classes for the scientific method, how to reason, what is critical thinking, all this got embedded in the definition of a major and the procedures they teach but truly students don't know what it means. we didn't learn how concepts are formulated, we don't learn PHILOSOPHY. contemplate this action's consequences. its a personal request.


There are Drs who teach wrong information, students correct their math on board and teachers give non convincing answers or bullshit their way out of it making it mission impossible to understand, literally, leaving behind holes in the students' brain, Drs won't think outside their notes that they want to fill up the board with, students end up signing with such a Dr because he has easy grades or mi7taker il maddeh.

Good students are the ones who learned to study alone.Through self-study and reading beyond course requirements in the text book

Drs who do power point presentations / use computer applications have to stick to the rooms that have "a data show" so its either the computer lab, the room with a key, or they would ask the secretary to give them the department data show and guess what,, these doctors use the whole fifty minutes reading off the presentation while the lights are off which is a nap atmosphere, in this kind of classes where the lecture is the presentation, students don't even read the book, we were not given any background reading to do, NEVER, I don't remember being asked for assigned reading, I was not asked about looking up a subject for discussion, very few did discussions and was in 5th year classes, they gave us weekly quizes and homework problem sets, some were very demanding but for the sake of it, few Drs did care that we understand, they spent the time showing us how problems are solved numerically, and asking us to do the same, a series of direct instructions, stick to the notes and the power point presentation, the past papers and you will pass, whatever report we did, there was a perfect answer that needs to be written.

The least attention is given to the Laboratories and conducting experiments, sometimes we were able to finish the lab in 30 minutes out of three hours, there was always past reports to look at and fill the tables, students don't pay attention since its a credit hour, but it is where we really apply what we are learning and I can't really put it in words, its bad. go see for yourself. the labs are old and very badly equipped, especially mechanical engineering labs, automation, control, thermal fluids.

Teachers in JU don't know how to be class facilitators, they don't bother reading the room, knowing the students on a personal level, don't know that a human brain disconnects after 50 minutes in 1 hour 30 minutes class, they don't know that they should give breaks, that they should include activities in class, that he needs to set expectations for the class and agree with the students on some ground rules, he should use variety of tools, flow charts, colors, videos, ppts, reading assignments, problem sets, and web pages and discussions. he should watch his tone of voice that it won't remain monotonous through the lecture, he should know that that who scribbles in class is not totally absent minded and most of all...

لا تستعملوا اسلوب التخويف

There is a truth, we are very much behind when it comes to teachers and technology. I can think of 3 Drs in the electrical engineering department who have a webpage, the rest don't. I swear a Dr in the Mechanical Engineering Department asked us to write him an e-mail so he would send us the presentations back instead of uploading it to a website, he replied back to fifty something student, I SWEAR.. The Computer Engineering Dept staff Webpages are still of Web 1.0 form. its still a one way communication, log on and check the announcements and download files, that's it, there are no online discussions, there are Drs who don't reply e-mails, and there are Drs who can't be found in their offices quite often, so you can say communication is not impossible but it does very sincerely SUCK!! not to mention if you are a girl, some Drs exhibit a sense of discomfort dealing with a female student, and this is so evident, they won't look you in the eye, and you have to be super polite when talking to them. the female voice is so silent, so non existent, girls sitting next to each other, in one row, questioning too little, having the group distribution automatically labeled as " the girls group " they always said girls commit to studying better, master the homeworks, but the guys are the better engineers! you wanna know why, because they go easy on girls when its a practical assignment! girls get a preferential treatment in classes. It makes others politer but reserves incompetency attitude towards females. guys always joke about female incompetency in my faculty, it was never not there.

As for the competency test, you can find the result file for Fall 07/08 here, it includes the Gender, Nationality, University, ID number, Tawjihi Grade, GPA, Exam Score and Rank. I omitted the names column.

why don't the branch students make a training session for the Drs on web 2.0 applications that can be used in the classroom ?? courses would give a drive for the classmates to work collectively and learn and lets say make wikis of knowledge by the end of the term that is a product of what you have done with the Dr .. WHAT YOU THINK?
